Le gouvernement permet aux employeurs d’imposer des forfaits jours sans accord des cadres

En catimini, le gouvernement a mis fin au volontariat pour les forfaits jours via un amendement intégré à la 6ème et dernière ordonnance travail en Commission Mixte Paritaire.

 

Le forfait jour (régime de temps de travail unique en Europe dans lequel le temps de travail est compté en jours par an, plutôt qu’en heures par semaine, mois ou année) concerne désormais plus de 50 % des cadres français.

Le forfait jour génère un accroissement très important du temps de travail : les cadres au forfaits jours travaillent en moyenne 46h30 heures par semaine. On ne démontre plus l’impact de ces horaires à rallonge sur la santé et le lien de causalité immédiat avec l’explosion du nombre de burnouts, notamment chez les femmes.

Cet amendement permet d’imposer un régime de forfait jours ou heures et de modifier un régime de forfait jours ou heures existant sans avoir besoin du consentement du salarié.

C’est la première fois en droit français que le consentement du salarié n’est plus requis en cas d’application d’un régime dérogatoire au temps de travail. Un accord d’entreprise pourra ainsi imposer à des salariés un forfait heures ou jours ou augmenter le nombre de jours travaillés.

Suite aux plaintes déposées par l’Ugict-CGT, la France a déjà été condamnée à quatre reprises par le Comité Européen des Droits Sociaux (CEDS, uridiction du Conseil de l’Europe chargée de contrôler le respect de la Charte sociale européenne) pour son régime de forfait jour, dû au fait que celui-ci qui ne garantit ni le respect du droit au repos, ni les obligations de l’employeur en matière de protection de la santé des salariés.

Cette jurisprudence a 15 annulations d’accords de branche par la Cour de Cassation. Celle-ci enjoint régulièrement le législateur à modifier la réglementation en matière de forfaits jours pour respecter les droits fondamentaux des salariés.

Le gouvernement faisait jusque là l’autruche sur cet aspect de l’organisation du temps de travail des cadres.

Avec cet amendement, son choix est désormais clair, et va dans le sens d’une remise en cause frontale des droits et principes fondamentaux en matière de temps de travail.

En décembre 2017, dans le cadre de la réforme du Code du Travail de 2016, la CGT et la CFE-CGC, ont saisi ensemble le CEDS pour la 5ème fois contre la législation des forfaits jours.

L’Ugict-CGT interpelle solennellement la Ministre du Travail et demande que cet amendement soit retiré sans délais.
